Local news: new NSW strata laws

On November 30 2016, more than 90 changes to strata laws in New South Wales came into effect, which impact over a million people across the state.

Smoking

It is now easier to raise a complaint about smoke from another apartment as it is now defined as a nuisance. Owners corps are also able to pass a by-law to define an area of common property as a designated smoking zone.

Parking

Owners corps are now able to make arrangements with your local council parking ranges to patrol their car parks. The aim is to prevent those who don’t reside in the property from using the parking available, especially for carparks close to commuter hubs.

Fines go to owners corp

Previously, all fines were paid to the government. Under the new strata laws, the money will go to the owners corp, hopefully giving extra incentive for committees to take action.

Renovations

New regulations separate renovations into three categories, each requiring different avenues to gain approval from the committee:

  1. Cosmetic: You will need to notify the committee
  2. Minor: You will require approval by a vote of the committee
  3. Major: Requires a special resolution at a general meeting
